Department Responsibilities

The Probate Court has jurisdiction over a variety of matters, including:

1. Probating wills and the administration of estates.
2. Overseeing testamentary and living trusts.
3. Determining title to real and personal property.
4. Construing the meaning of wills and trusts.
5. Appointing guardians for persons with intellectual disabilities.
6. Appointing conservators of the person and estate for incapable individuals.
7. Committing individuals suffering from psychiatric disabilities or drug and alcohol addiction to an appropriate facility.
8. Removing guardianship rights of parents and appointing temporary custodians and guardians for minor children.
9. Terminating the parental rights of parents who cannot fulfill their parental responsibilities.
10. Granting adoptions.
11. Granting name changes.
12. Approving the issuance of marriage licenses to persons between the age of 16 and 18 years old.
13. Quarantine and isolation orders for public health emergencies.
14. Tuberculosis treatment orders.
15. Removal of life support and other end-of-life decisions.
